Who owns what
The text, design, structure, layout, photography and code of this site belong to David Oiaknin or to those who licensed them to him, and are protected by copyright and related rights.
The name David Oiaknin, and the names of any companies referenced here, belong to their respective owners. Nothing on this site grants you a licence to use them.
Fair quotation, commentary, news reporting and criticism are unaffected — those rights exist in law and we are not trying to sign them away.
04
Anything you send us
When you write through the contact form you keep ownership of what you wrote. You give us permission to read it, store it, and act on it for the purpose of responding to you.
Please treat the form as an unsecured channel. Do not send confidential material, personal identifiers, financial account details, or anything you would not want sitting in an inbox. Nothing you send is treated as confidential unless we have separately agreed in writing that it is.
We do not accept unsolicited business proposals, pitches, inventions or concepts on the understanding that they are secret. If you send an idea unprompted, you accept that we may already be working on something similar, and that receiving it creates no obligation of any kind.
05
The site is provided as it is
This site is provided on an "as is" and "as available" basis. We make no warranty that it will be uninterrupted, error-free, secure, or free of anything harmful, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement to the extent the law allows.
We may change, suspend or withdraw any part of this site at any time, without notice, and without owing anyone an explanation.
06
Limits on liability
To the fullest extent permitted by law, neither David Oiaknin nor anyone connected with this site is liable for indirect, incidental, special, consequential or punitive loss arising from your use of it — including lost profits, lost opportunity, lost data or business interruption.
Some jurisdictions do not allow certain exclusions. Where that is the case, this clause applies as far as it lawfully can and no further, and nothing here excludes liability for fraud or for anything that cannot lawfully be excluded.
07
Indemnity
If your misuse of this site causes a claim against us, you agree to cover the reasonable costs of dealing with it. This is aimed at deliberate abuse, not at ordinary readers.
08
Links out
Third-party sites linked from here are not under our control. We are not responsible for what they publish, what they collect, or what they do. Visiting them is your decision and their terms govern it.
09
Law and venue
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes arising out of this site are subject to the exclusive jurisdiction of the state and federal courts located in California.
If any provision here is found unenforceable, the rest stands.
